Right of revocation
You may revoke your declaration to conclude a sales contract within a period of two weeks in textual form (e.g. by letter, e-mail, facsimile) or - if the item is placed at your disposal prior to the expiry of this period - by returning the goods.
The grace period for revocation begins earliest upon receipt of the goods and this notification by the recipient (in case of recurring deliveries of the same type of goods not before receiving the first partial delivery) and not before we have met our information duties and other duties as defined by Civil Code (§ 312c sec 2 BGB in conjunction with § 1 sec. 1, 2 and 4 BGB-InfoV as well as § 312e sec 1 clause 1 BGB in conjunction with § 3 BGB-InfoV). Consequences of revocation
In the event of effective withdrawal any mutually received benefits are to be refunded and possible benefits derived (e.g. from use) to be returned. Should the customer not be able to return the goods or only return them partially or in a deteriorated condition then the customer will be obligated to value replacement. In the case of the item being delivered, this only has validity in as far as the deterioration of the item exclusively results from its inspection such as would be the case in a store, for example . In other respects you can avoid the obligation to compensate for deterioration due to the utilisation of the good as intended by not using the goods as if they were your property and by refraining from doing anything that could impair their value.
You have to bear the costs of the return if the delivered goods conform to the ordered ones and if the price of the returning goods does not exceed an amount of 40,00 Euros. You also have to pay for the return although the price exceeds 40,00 Euros, when you have not reciprocated or performed a partial payment as contracted at the time of the revocation. In all other cases return delivery is free of charge for you. Non transportable things will be picked up at your place.
Requests for re-compensation for payments must be met within 30 days after sending the declaration of withdrawal or after returning the goods.
End of the revocation notice
The power of revocation does not apply to distance selling contracts for the delivery of merchandise which: is either custom-made to customers specifications or is clearly custom-tailored to meet personal demands or is not fit for reshipment due to properties and conditions or is apt to suffer spoilage or has reached its expiry date
The power of revocation is not applicable if you are an entrepreneur under § 14 German Civil Code (BGB) and are engaged in according commercial or freelance business activities at the time of the contracts conclusion
2. Conclusion of the contract
Your order presents an offer to us to conclude a purchase contract. When you submit an order to www.aquakeramik.de, we will send you an email confirming our receipt of your order and listing its details (order confirmation). This order confirmation does not constitute an acceptance of your offer, it is just to inform you that your order has been received. The contract of sale comes into existence as soon as we send you a confirmation of the order by email directly after receiving your order
3 Reservation of title
The goods delivered remain our property until full payment has been received.
4. All prices include the Value Added Tax, but do not include the shipping costs. We deliver with DHL or with another parcel service of our choice. Information about shipping costs can be found in the Terms of Payment and Delivery
5. Terms of Delivery. The delivery usually takes place within 2-4 days after receipt of payment and according to availability. We deliver with DHL or with another parcel service. Please make sure that on the day of delivery a person is there to accept the consignment. If the delivery of the goods fails, and a required feedback has not been made and the goods have not been picked up at the parcel service then we are authorized to withdraw from the contract; if any payments have been done, Aquakeramik will refund the money
Should we not hold all ordered products on stock, we are entitled to partial shipments at our costs, provided this can be reasonably imposed on you
6. Delivery Limitations
The purchaser must be of legal age. In the event that an article you have ordered is unavailable, we are entitled to inform you immediately and to refund any advance payments received immediately
7. Terms of Payment
The offered Payment Methods are sure. Products ordered via the internet must be paid by surname in advance or via credit card or PayPal. A payment by mailing cash or cheques is not possible. We exclude a liability for any loss.
8. Warranty
The guarantee takes place according to the legal regulations. If the delivered items have obvious material or production defects, which may include transport damage, please complain to the employees of the parcel servicer of such defects immediately. However, even if you neglect to make such complaint, your legal rights remain unaffected.
9 Privacy
To handle your order in a effective way we have to store personal data necessary for handling the business. Of course these data arent passed on to third parties. To protect you against access from the outside we use SSL to encrypt your order
